The defendant Anthony W. Geier was found guilty by the county court of Dane county of racing his automobile on the capitol square in the city of Madison in violation of city ordinance sec. 12.86. On appeal to the circuit court, the conviction was reversed on the ground of insufficient evidence to sustain it. The plaintiff city of Madison appeals. Upon the consideration of the case the court requested briefs on the question of whether the burden of proof applied in ordinary civil cases was applicable also to ordinance violations involving criminal acts or whether the higher standard of proof which is applied in fraud and similar cases was applicable. Briefs were filed by the parties and by amici curiae.
