Sec. 11.04, Stats. (now sec. 5.40) was created by ch. 136, Laws of 1963. It requires that all cities and villages over 10,000 in population purchase or adopt voting machines for use in the September, 1966, primary election. The common council of any other city, the trustees of any other village, and the town board of any town could adopt and purchase voting machines but were not required to do so. On April 4, 1966, the common council of the city of Kenosha passed Charter Ordinance No. 17. The Charter Ordinance was promulgated pursuant to the home-rule provisions of sec. 3, art. XI of the Wisconsin constitution, and sec. 66.01 (4) of the Wisconsin statutes, and provided that the city of Kenosha elected not to be governed by sec. 11.04, Stats.
